The New Jersey Library Association has reviewed the recent letter opinion issued by Judge Yolanda Ciccone in the case of Aaronson v. Borough Council of the Borough of Somerville, et. al.
According to this opinion the Somerville Public Library remains a recognized legal entity governed by Somerville Public Library Board of Trustees. It has not been dissolved.
Through the course of the case, the Board of the Somerville Public Library used its legal authority to enter into an amended, finite service agreement with the Somerset County Library.
The New Jersey Library Association believes this opinion validates its long-held position that a municipal public library established by referendum can only be dissolved in the same manner.
